…Mr. Vladeck, if somebody just tuned in for part of your conversation, what they heard you say was that government can collect your bank data, your GPS data in your car, and I assume the metadata on your phone that we’re talking about. Is there actually authority to do that or were you making that up?

So you’re not suggesting at all that the government is currently under the 215 collecting bank data or…?

Stephen I. Vladeck, Professor at American University Washington College of Law:
No, not to my knowledge at all. The only point I was trying to make, Congressman, is that there is a difference and one that I think is not well-appreciated in most public discussions between the notion that we are surrendering our privacy when we give information to one private third-party and the notion that the government should therefore have access, whether or not it2 currently does, to all of the data that we provide to all third-parties.
