May 2002: Jose Padilla was arrested on a material witness warrant at Chicago’s O’Hare Airport. A material witness warrant is generally issued to guarantee a witness’s appearance in court. Under the direction of then-Attorney General John Ashcroft, material witness warrants were used to detain terrorism suspects when law enforcement officials lacked sufficient evidence to charge the individuals with a crime.
